NOTICE OF PUBLIC HEARING ON CENTRAL ARIZONA GOVERNMENTS (CAG) SECTION 208 WATER QUALITY MANAGEMENT PLAN AMENDMENT FOR THE CITY OF APACHE JUNCTION/SUPERSTITION MOUNTAIN COMMUNITY FACILITIES DISTRICT NO. 1, FOR THE EXPANSION OF THE CITY’S DESIGNATED MANAGEMENT AGENCY (DMA) BOUNDARIES, EXPANSION OF THE CITY’S SERVICE AREA BOUNDARIES, AND INCREASE THE BUILD-OUT CAPACITY OF THE EXISTING WATER RECLAMATION FACILITY, WITHIN PINAL COUNTY, ARIZONA.

CAG will conduct a public hearing on:

DATE:                 Tuesday, November 30, 2021
TIME:                  6:00 PM – 7:00 PM
PLACE:                Superstition Mountains Community Facilities District No. 1
                           District Board Room
                           5661 South Ironwood Drive
                           Apache Junction, AZ  85120

The purpose of this hearing is to discuss and comment on the Central Arizona Governments (CAG) Section 208 Water Quality Management Plan Amendment for the City of Apache Junction’s/Superstition Mountain Community Facilities District No. 1 (City/SMCFD).

The hearing will address the expansion of the City’s current DMA boundary by approximately 11 square miles, expansion of the City’s Service Area boundary, and to increase the current approved Build-Out capacity of the wastewater reclamation facility, located at 5661 South Ironwood Drive, Apache Junction, AZ  85120 from 16 million gallons per day (MGD) to 26 MGD.  The City’s DMA boundary is recognized by the Arizona Department of Environmental Quality (ADEQ) and the United States Environmental Protection Agency (EPA) through Section 208 of the Federal Pollution Control Act (Clean Water Act).  The proposed DMA expansion is predominantly Arizona State Trust Land and is currently undeveloped.  Estimates for Build-Out capacity of wastewater flows for the DMA boundary expansion are based on ADEQ guidelines, engineering estimates, and transition from current to anticipated land use zoning and densities.

The designation of a DMA provides the City the right to effectively plan for wastewater services and obligates the City to provide for the maintenance and protection of ambient water quality in the proposed area.  The City, via SMCFD, has demonstrated that it meets the legal, financial, and technical capabilities to carry out water quality planning for the proposed expansion.

The proposed plan amendment addresses how the City/SMCFD will manage the wastewater resources within its DMA to ensure compliance with all regulatory and permitting requirements, and to meet the demands of existing and proposed development.

Written comments may be submitted to CAG no later than 6:00 PM on Tuesday, November 30, 2021.  A summary of the public comments received will be submitted as part of the Amendment Package to ADEQ for further consideration.  Written and verbal comments are welcome at the Public Hearing.  A copy of the CAG 208 Plan Amendment to the CAG Section 208 Water Quality Management Plan for the City of Apache Junction/Superstition Mountain Community Facilities District No. 1 will be available for public review starting Wednesday, October 13, 2021 online on CAG’s website www.cagaz.org.  Hard copies can be reviewed starting the same time at the following locations:
